Privacy policy
At Housiders we look after your data. This policy explains what personal data we process when you use housiders.com, why, on what legal basis, for how long, who else may receive it and how you can exercise your rights. It complies with Regulation (EU) 2016/679 (GDPR), Spanish Organic Law 3/2018 (LOPDGDD) and Law 34/2002 (LSSI-CE).
1. Data controller
The controller is the owner of the Website, identified in the legal notice (trade name: Housiders). For any question about your data you can write to us through the contact form, or by post to the address in the legal notice.
2. What data we process and why
2.1. Enquiries through the contact form, WhatsApp or email
- Data: name, email, phone, topic and the message you write to us (on WhatsApp, also your number and whatever you tell us).
- Purpose: to deal with your enquiry and reply to you.
- Legal basis: your consent (art. 6.1.a GDPR) when you send us the form or write to us, and the application of pre-contractual measures at your request (art. 6.1.b).
- Retention: for as long as needed to deal with your enquiry and, afterwards, blocked for the limitation periods of possible liabilities.
2.2. Ordering a kit (Inmo Kit Media)
- Data: listing link, name, agency, email, phone, the languages you want and the material you send us (property photos and logo); billing details you provide when paying.
- Purpose: to manage your order, provide the service, deliver the kit, handle the review, invoice and communicate with you about the order.
- Legal basis: performance of the contract or of pre-contractual measures (art. 6.1.b) and compliance with legal invoicing and tax obligations (art. 6.1.c).
- Retention: while the relationship lasts and, afterwards, for the periods required by commercial and tax law (up to 6 years for accounting documents and invoices) and the limitation periods of liabilities.
If the material you send us contains personal data of third parties (for example, people who appear in a photo), you are responsible for having the right to provide it to us and we will process it only to provide you with the service.
2.3. Payment
Payment is made on Stripe's page. Stripe processes your payment data (card, billing) as a payment service provider, under its own privacy policy. We receive confirmation of the payment, your email and billing details, but not your full card details.
2.4. Booking a call
If you click “Book a call”, the Calendly calendar loads. Calendly receives the data you enter (name, email, chosen slot) and processes it under its privacy policy; we use it to hold the call. Legal basis: your consent and pre-contractual measures at your request. Nothing from Calendly is loaded until you click the button.
2.5. Measuring the use of the Website (analytics)
- Data: browsing data (pages viewed, events such as clicks on WhatsApp or form submissions, device, browser, approximate location) with Google Analytics 4 cookie identifiers. We do not include your contact details in events.
- Purpose: to understand how the Website is used and improve it.
- Legal basis: your consent (art. 6.1.a GDPR and art. 22.2 LSSI-CE), which you can accept, reject or withdraw at any time (see the cookie policy). We keep analytics data for a maximum of 14 months.
2.6. Commercial communications
We do not send commercial communications by email without your prior consent or a contractual relationship that allows it, in accordance with article 21 of the LSSI-CE.
3. Recipients and providers
We do not sell your data. We only share it with those who provide us with services needed to run the Website and the service, who act as processors or, where applicable, as independent controllers:
- Amazon Web Services (hosting of the Website and, where applicable, storage of order material).
- Resend (sending the internal emails with your forms).
- Stripe (payment processing).
- Calendly (call booking, only if you use the calendar).
- Google (Google Analytics, only if you accept measurement cookies; and Google Drive, to receive photos and logo when the property has no listing link).
- Advisers, accountants and financial institutions, and public authorities when the law requires it.
Some of these providers may process data outside the European Economic Area (for example, in the United States). In that case we make sure adequate safeguards exist, such as the European Commission's standard contractual clauses or the provider's adherence to the EU–US Data Privacy Framework.
4. Your rights
You can exercise the following rights over your data at any time:
- Access: to know what data of yours we process.
- Rectification: to correct inaccurate or incomplete data.
- Erasure: to ask us to delete it when it is no longer needed, among other cases.
- Objection: to object to processing based on our legitimate interest.
- Restriction: to ask us to stop using it temporarily in the cases provided.
- Portability: to receive your data in a structured format, where applicable.
- To withdraw your consent where processing is based on it, without affecting what has already been done.
To exercise them, write to us through the contact form, stating the right you are exercising and a means of contact; we may ask you to prove your identity. We will reply within one month (extendable under the GDPR). If you believe we have not processed your data in accordance with the regulations, you can complain to the Spanish Data Protection Agency (aepd.es).
5. Automated decisions and minors
We do not make decisions based solely on automated processing that produce legal effects on you. The Website and the services are aimed at professionals of legal age; if you believe a minor has given us data, let us know and we will delete it.
6. Security
We apply reasonable technical and organisational measures to protect your data (encrypted connections, access control, providers with security certifications) and require our providers to offer an equivalent level of protection. If there were a security breach affecting you, we would notify you and, where appropriate, the authority.
7. Cookies and changes to this policy
You can see which cookies we use and change your choice in the cookie policy. We may update this policy to reflect legal or service changes; the current version is the one published here, with its last-updated date.
